Court: Can EPA regulate mud from logging roads?

GRANTS PASS, Ore. (AP) ? The timber industry is hoping that the U.S. Supreme Court will maintain business as usual on controlling muddy water running off logging roads into salmon streams.

The high court decided Monday to take up a 9th U.S. Circuit Court of Appeals ruling that federal regulators should treat stormwater on industrial timberlands the same as pollution discharged from a factory, changing the longstanding practice that treats it like water coming off farm fields.

The ruling on an Oregon case would apply to logging roads on state, private and national forest lands throughout the jurisdiction of the 9th Circuit, which covers much of the West. Most of the roads are graveled, but some are paved or bare dirt.

Tom Partin, president of the American Forest Resource Council, said increased regulation would cost money and offer conservation groups new opportunities for blocking logging without producing any cleaner water.

"Over the years, we have been able to continually improve our practices as we have learned more about the environment," he said in a statement. "Water flowing from our forests is high quality,"

Paul Kampmeier, a lawyer for the Washington Forest Law Center, which represents conservationists, said the high court was presented with arguments urging them to take up the case from 26 states, including Oregon, as well as the timber industry.

"I think the defendant, or the petitioners now, did a very good job of making it sound like the sky is falling," if the ruling stands, Kampmeier said. "Congress is political, and there is political pressure on EPA...I think we will get a fair and impartial ruling from the Supreme Court."

The appeals court ruled in 2010 that the muddy water running off roads used in industrial logging is the same as any other industrial pollution, requiring a Clean Water Act permit from EPA. Scientists have long identified sediment running into salmon streams from erosion as a leading cause of habitat loss because it chokes off the gravel beds where salmon lay their eggs.

The case was brought by the Northwest Environmental Defense Center in Portland, Ore., against the Oregon Department of Forestry over logging roads on the Tillamook State Forest.

The Obama administration petitioned the Supreme Court not to take the case. It argued that while it felt the appeals court ruling was wrong, there was no reason for the Supreme Court to get involved, because Congress and the Environmental Protection Agency were taking steps already.

Last May, EPA formally proposed to revise stormwater regulations to say logging roads don't need the point-source pollution permits that factories must get, effectively blunting the ruling.

Instead, the roads would be regulated under a less stringent system known as "Best Management Practices," where authorities set up guidelines for the design and maintenance of logging roads to minimize erosion that sends mud into rivers. EPA started reviewing how states and tribes handle the issue, and planned to put out new rules by Sept. 30, when an exemption for the timber industry enacted by Congress expires.

Dave Tenny, president of the National Alliance of Forest Owners, questioned the need for EPA to continue developing new regulations for logging roads now that the issue would be decided by the high court.

"The basic question in the case is what kind of deference the courts give an agency to interpret the statutes and their own regulations," Tenny said. "The 9th Circuit interjected itself into the realm of the regulatory agency. And that's inappropriate."

Oregon Department of Forestry spokesman Dan Postrel said the current system has done a good job of protecting water quality for many years without federal permits.

Kampmeier said only roads with trucks actively hauling timber that discharge water into streams would require permits.

"We have confidence the Supreme Court will agree that when the EPA said discharges associated with industrial logging activities requires a permit, EPA is allowed to say that," he said.

Asked whether it would continue working on new regulations, an EPA spokeswoman referred comment to the U.S. Department of Justice, which declined to comment on pending litigation.

Wizards Pre-NBA Draft Workouts: Sam Cassell vs. Hollis Thompson

Former Georgetown Hoya Hollis Thompson was all of two-years old when Sam Cassell made his NBA debut with the Houston Rockets in November of 1993.

So, with Cassell serving as an assistant coach with the Washington Wizards, who have been putting 2012 NBA Draft hopefuls through workouts, including Thompson last Thursday, we are given a chance to crunch the age numbers as the two faced-off in a drill on the Verizon Center practice court.

Cassell will turn 43-years old this November, and Thompson turned 21 this past April; the difference between them ? 21 years, 4 months and 16 days ? is currently greater than Thompson?s age.

The drill was defensive in nature. Participating players were required to rotate properly on help defense as the ball was passed around. The final component involved the main defender rotating from helping in the paint to closing out on a wing player in the corner (Cassell) using proper technique.

From there, Cassell had free reign to relish the opportunity of scoring on a kid at least 50-percent less in age. And this wasn?t the first time Cassell has dueled with kids ? previous battles have come against the likes of?John Wall, Nick Young, JaVale McGee, and Andray Blatche ? and it likely won?t be the last.

Cassell?s first bucket on Thompson came thanks to his expectantly unexpected craftiness, a scoop shot under Thompson?s obliviously defending arms. The 21-year old demanded another chance, and Cassell scored on him again; this time with a tough shot off the backboard glass ? he called it.

?Hey GM! You got this on tape?? yelled Cassell up toward the onlooking Wizards brass, media members other viewing parties. Cassell?s question came after he put on a display of his 42-year old prowess with a strut. Sam I Am may not have invented NBA swagger, but he?s certainly in the Hall of Fame.

Thompson didn?t strike out a third time, however. He closed out on Cassell tight and used his 6-foot-8 frame to bother the one-time All-Star, three-time NBA Champion into a bricked miss.

But hey, two out of three ain?t bad for an old man.

The Republicans? One And Only Jobs Plan ? Bad For Jobs, Energy Independence, Environment (VIDEO)

Like the old adage, ?when a bell rings, an angel gets its wings,? when a TV studio light shines, a right-wing pundit touts the amazing job creating capabilities of the Keystone Pipeline. The pipeline, they say, will solve all our financial woes. Magically, we will have 4% unemployment and complete independence from middle eastern oil.

If only any of that were true. In this video, CNN shows that while the pipeline might create around 20,000 short-term jobs, the long-term jobs will number only in the 100s. There are 12.7 million unemployed people in the US. Even at the 20,000 rate, the singular GOP jobs plan would decrease the number of unemployed by .0016%.

The Obama jobs plan, on the other hand, would provide between 1.5 million and 2 million jobs. Obviously, this still isn?t enough, but jobs, unlike tax cuts for the wealthy, actually do trickle down. Every employed person stops being a burden to the taxpayer and starts being a taxpayer, increasing our country?s bottom line. Every employed person buys things, enabling retailers to expand. Our biggest way out of the recession is to put more people back to work, not to say we can?t afford to put people back to work.

Maybe I?m wrong. Maybe CNN is wrong. Maybe there are some long-term jobs to be found with the Keystone Pipeline. While there isn?t, as of yet, a dollar value placed on the environmental damage the pipeline, extending from Canada to the Gulf Coast, has done or will do, look for it to be significant.

From CNN:

Tar sands oil production?has already created more than 50 square miles of toxic waste ponds so massive they are visible from space. Even more important, tar sands oil extraction produces three times more greenhouse gas emissions than conventional oil and gas, putting even greater strain on our atmosphere and oceans, which have little absorptive capacity left.

Closer to home, the pipeline presents an immediate threat to drinking water for millions and to the livelihood of farmers and ranchers. To transport via pipeline, the thick tar sands crude must be mixed with toxic chemicals and then pumped at extreme temperature and pressure. This sets the stage for more pipeline failures and spills that create a highly toxic mess.

The existing Keystone 1 tar sands pipeline has spilled more than 12 times in its first 12 months of operation. In July 2010, a spill of more than 800,000 gallons of toxic tar sands crude from the Enbridge pipeline?contaminated more than 30 miles of water and shoreline along the Kalamazoo River in Michigan.?This created public health problems, threats to groundwater, widespread fish kills, and destruction of wildlife habitat, contamination that is still being cleaned up at a cost exceeding $700 million. Downstream landowners like me are thinking this is a preview of coming attractions if Keystone XL is built.

Look for toxic waste cleanup to be the next boom industry, should the Keystone XL go forward.

But what about all-important energy independence? The pipeline is also a dud on that front. From Tar Sands Action:

Keystone XL is an export pipeline. According to?presentations to investors, Gulf Coast refiners plan to refine the cheap Canadian crude supplied by the pipeline into diesel and other products for export to Europe and Latin America. Proceeds from these exports are earned tax-free. Much of the fuel refined from the pipeline?s heavy crude oil will never reach U.S. drivers? tanks.

In fact, the pipeline would actually increase the price of gasoline.

It should come as no surprise that the GOP?s only jobs plan, other than more tax cuts, won?t get us out of our unemployment crisis. Their singular goal is not to help the country, it is to see that one more person loses his job, Barack Obama.

(AP) ? On the afternoon of April 29, 1992, after a harrowing three-month trial of four police officers in the Rodney King beating case, jurors sent word that they had reached verdicts.

I was apprehensive as I entered the courtroom with other reporters. The verdict was being televised and we knew the announcement would surely be the biggest story of the day. But we could not know how big.

When the clerk's voice rang out with the verdicts ? four counts not guilty and one deadlock ? there was a collective gasp of astonishment in the courtroom.

I remember shouts of dismay from the audience and then the reporter seated next to me said in a matter-of-fact voice: "I guess we'll have to go cover the riots now."

Little did she know that within minutes, violence would be breaking out at Florence and Normandie Avenues about 40 miles away in Los Angeles. Before long, the city would be a war zone.

By the time I had finished filing my verdict story, roads to Los Angeles were closed. I had been staying in Simi Valley for the trial and that's where I remained, gathering reaction and trying to find out if I would still have a home when I returned. A neighbor told me of standing on her terrace watching the city burn. But it did not reach our area.

Marooned in Simi Valley, I went out in search of jurors and found one who said she had prayed, wept and fasted during deliberations hoping to sway other panel members to reach at least one guilty verdict. That story was a sensation and cast the verdicts in a new light. But it was too late to make a difference.

Although he was not the defendant, the trial that lit the spark for the worst riots in Los Angeles history would always be known as the Rodney King trial. We reporters thought of it that way even though King never appeared at that trial and may have never even visited the town of Simi Valley where it was held.

He was an ever present figure on videotape, a beating victim whose repeated assault by police officers with batons, boots and a stun gun was shown so many times that it seemed like a recurring nightmare. Defense attorneys dissected it, frame by frame, trying to show that King had incited his own beating.

The case had been moved on a change of venue because of saturation publicity in Los Angeles. But Simi Valley was an odd choice, a police officers' bedroom community with a predominantly white population. There were no blacks on the jury. The brand new courthouse had no other cases under way, and it seemed as if the trial was being held in a cocoon away from the urban pressures that spawned the case.

In 1993, the U.S. Justice Department held another trial in Los Angeles in which the same officers were charged with civil rights violations. King testified in that trial, a handsome, hesitant but well-spoken and well-dressed man who described his beating and said he was taunted with racial epithets.

Verdict day was tense because of what had gone before. Mounted police surrounded the federal courthouse on a Saturday when the civic center was quiet. This time there were convictions and two officers went to prison. There was no violence.

By the time King's federal civil suit against the City of Los Angeles was tried in 1994, everyone seemed tired. I was one of the few reporters to cover all three trials and the courtroom no longer drew standing room only crowds. The jury ultimately awarded King $3.8 million in compensatory damages, far lower than his lawyer had expected, and they gave him no punitive damages.

Three years after King was beaten, the court cases finally were over. But the city would be dealing with the aftermath for decades.

Rodney King, key figure in LA riots, dies at 47

LOS ANGELES (AP) ? Rodney King, the black motorist whose 1991 videotaped beating by Los Angeles police officers was the touchstone for one of the most destructive race riots in the nation's history, was found at the bottom of his swimming pool early Sunday and later pronounced dead. He was 47.

King's fianc?e called 911 at 5:25 a.m. to report that she found him in the pool at their home in Rialto, Calif., police Lt. Dean Hardin said.

Officers arrived to find King in the deep end of the pool and pulled him out.

King was unresponsive, and officers began CPR until paramedics arrived. King was taken to the hospital, where he was pronounced dead at 6:11 a.m., police said.

Police Capt. Randy De Anda said King had been by the pool throughout the early morning and had been talking to his fiancee, who was inside the home at the time. A statement from police said the preliminary investigation indicates a drowning, with no signs of foul play.

Investigators will await autopsy results to determine whether drugs or alcohol were involved, but De Anda said there were no alcoholic beverages or paraphernalia found near the pool.

Authorities didn't identify the fianc?e. King earlier said he was engaged to Cynthia Kelley, one of the jurors in the civil rights case that gave King $3.8 million in damages.

The 1992 riots, which were set off by the acquittals of the officers who beat King, lasted three days and left 55 people dead, more than 2,000 injured and swaths of Los Angeles on fire. At the height of the violence, King pleaded on television: "Can we all get along?"

King, a 25-year-old on parole from a robbery conviction, was stopped for speeding on a darkened street on March 3, 1991. He was on parole and had been drinking ? he later said that led him to try to evade police.

Four Los Angeles police officers hit him more than 50 times with their batons, kicked him and shot him with stun guns.

A man who had quietly stepped outside his home to observe the commotion videotaped most of it and turned a copy over to a TV station. It was played over and over for the following year, inflaming racial tensions across the country.

It seemed that the videotape would be the key evidence to a guilty verdict against the officers, whose trial was moved to the predominantly white suburb of Simi Valley, Calif. Instead, on April 29, 1992, a jury with no black members acquitted three of the officers on state charges in the beating; a mistrial was declared for a fourth.

Violence erupted immediately, starting in South Los Angeles.

Police, seemingly caught off-guard, were quickly outnumbered by rioters and retreated. As the uprising spread to the city's Koreatown area, shop owners armed themselves and engaged in running gun battles with looters.

During the riots, a white truck driver named Reginald Denny was pulled by several black men from his cab and beaten almost to death. He required surgery to repair his shattered skull, reset his jaw and put one eye back into its socket.

King himself, in his recently published memoir, "The Riot Within: My Journey from Rebellion to Redemption," said FBI agents warned him a riot was expected if the officers were acquitted, and urged him to keep a low profile so as not to inflame passions.

The four officers who beat King ? Stacey Koon, Theodore Briseno, Timothy Wind and Laurence Powell ? were indicted in the summer of 1992 on federal civil rights charges. Koon and Powell were convicted and sentenced to two years in prison, and King was awarded $3.8 million in damages.

The police chief, Daryl Gates, who had been hailed as an innovator in the national law enforcement community, came under intense criticism from city officials who said officers were slow to respond to the riots, and resigned under pressure soon after. Gates died of cancer in 2010.

In the two decades after he became the central figure in the riots, King was arrested several times, mostly for alcohol-related crimes, the last in Riverside Calif., last July. He later became a record company executive and a reality TV star, appearing on shows such as "Celebrity Rehab."

In an interview earlier this year with The Associated Press, King said he was a happy man.

"America's been good to me after I paid the price and stayed alive through it all," he says. "This part of my life is the easy part now."

Rev. Al Sharpton said in a statement that King was a symbol of the civil and anti-police brutality movement.

"Through all that he had gone through with his beating and his personal demons he was never one to not call for reconciliation and for people to overcome and forgive," Sharpton wrote. "History will record that it was Rodney King's beating and his actions that made America deal with the excessive misconduct of law enforcement."

Attorney Harland Braun, who represented one of the police officers, Ted Briseno, in the federal trial, said King's name would always be a part of Los Angeles history.

"I always saw him as a sad figure swept up into something bigger than he was," Braun said. "He wasn't a hero or a villain. He was probably just a nice person."

King's case never would have become such a symbol without the video, he said.

"If there hadn't been a video there would have never been a case. In those days, you might have claimed excessive force but there would have been no way to prove it."

The San Bernardino County coroner will perform an autopsy on King within 48 hours.

Upgrading to a Premium account removes ad interruptions, and lets you store playlists offline (up to 3,333 tracks), and sync your account to an unlimited number of mobile devices. Trust me, it's worth it. If you don't have Premium, you can (and absolutely should) sign up for a free 30-day trial to enjoy our Editors' Choice pick for premium music services on your Android device.

If you'd rather not pay a dime and don't mind being unable to listen to individual tracks or albums on demand, Songza is the Editors' Choice among free music services, and it supports iOS and Android. Slacker Radio ($9.99, 4.5 stars), another Editors' Choice pick on the PC and iPad, serves tons of streaming radio stations. For a pure cloud-based music player, Google Play Music is a solid option, but you can only share a full stream with Google+ members and you can only add music you've purchased through Google Play.

Better Look and Feel
Spotify for Android looks more like Spotify for iPad (4 stars) than Spotify on an iPhone or desktop. The app sheds Spotify's original black and green color scheme for lots of clean lines, white space, and grey trim. Graphics, particularly album covers, are so vivid they almost pop. It's a beautiful way to play music on a tablet.

Navigation is faster and snappier, too, thanks to lots of buttery-smooth scrolling and swiping. For example, you can swipe left to access your Settings menu to open your playlists, Inbox, Friends list, song recommendations, and search box. The menu simply layers on top of an existing page.

Better Than the iPhone Version?
This is the first Android app I've reviewed that performs better than its iPhone counterpart. Not only is it faster and more intuitive, it also ports a few awesome desktop features.

Sound quality is better. You can now stream or download tracks at a deliciously high 320kbps, called Extreme mode. It'll hog your data, so use it sparingly or with Wi-Fi. Spotify for Android also now supports gapless playback and crossfading between tracks, so there aren't any abrupt pauses.

Looking for new music? From Settings, tap What's New to see trending songs and playlists among Spotify friends and members located near you, or swipe through a slick carousel of new albums. This section is limited to only five options each, however. The desktop client recommends twice the amount. Spotify for Android also lets you build perfect playlists. For instance it adds Spotify's Play Queue, a scrollable list that displays what songs lie ahead of your currently playing track. You can drop in tracks at any time, even if you're listening to someone else's playlist.

Adding two desktop-only features would make this app just about flawless. It needs to support locally stored files so I could finally delete iTunes. And it needs to support Spotify's new app ecosystem, which I considered an awesome feature in my review of the desktop service. Spotify apps are simply third-party curated playlists; you'll find big name apps from Last.fm, Songkick, and Rolling Stone magazine.

An Incentive to Upgrade
Spotify, our Editors' Choice pick for premium music players on Android, is an incredible service that has essentially eliminated my need to ever buy music again. And it clearly understands mobile: Spotify for Android is a gorgeously designed app, approaching all the features offered by its desktop client. If it ever supports locally stored files, I'm deleting all my music player and music storage apps. Highly recommended.

Synopsis for Neill Blomkamp's Elysium Released

Anticipation is high for filmmaker Neil Blomkamp?s followup to his breakout hit District 9, which is another sci-fi project titled Elysium. However, save for a handful of set photos ? revealing Matt Damon with a shaved head, bloodied clothing, and unidentified futuristic body equipment ? there hasn?t been any news of substance to report since Blomkmap began shooting his sophomore feature.

Prior to now, virtually nothing in the way of concrete information has been revealed about the storyline for Elysium, other than what little can be gleaned from the titular reference to the Elysian Fields from Greek mythology (a final resting place for noble souls). A newly-unveiled synopsis sheds light on how that story ties?into the film?s central narrative, on a literal and figurative level (a la Prometheus).

The first preview audience screening has been held for Elysium, and invitations to said event (made available online thanks to?Collider) include an encompassing, NON-SPOILER summary of the film?s plot (you can read it below):

In the year 2159, two classes of people exist: the very wealthy who live on a pristine man-made space station called Elysium, and the rest, who live on an overpopulated, ruined Earth. Secretary Rhodes (Jodie Foster), a hard line government of?cial, will stop at nothing to enforce anti-immigration laws and preserve the luxurious lifestyle of the citizens of Elysium. That doesn?t stop the people of Earth from trying to get in, by any means they can. When unlucky Max (Matt Damon) is backed into a corner, he agrees to take on a daunting mission that, if successful, will not only save his life, but could bring equality to these polarized worlds.

Previous (unconfirmed) reports indicated that Damon?s character is an ex-convict, which has prompted speculation about what the aforementioned body suit could be. One of the popular theories (among others) pegs the mechanical appendage as a life-supporting item, thus making?Max (by definition) a cyborg; that could set the stage for Blomkmap?s film to explore the increasingly prevalent role technology plays in our everyday lives (similar to the impending RoboCop remake). Bear in mind, though, that guess could also be WAY off base.

Moving past that ? Elysium appears to offer a mix of gruesome violence, thrills, and sci-fi allegory along the lines of District 9. The logline alludes to a storyline that addresses timely issues of social upheaval and class warfare, which are currently all the rage in both movies (The Hunger Games, Dark Knight Rises) and on television (Legend of Korra). It also suggests a place for the ?antagonist? being portrayed by Wagner Moura, who?s previously been described as a divisive, but charismatic figure involved with human trafficking (possibly, into Elysium).

Supporting roles in Elysium will be filled out by people like District 9 star Sharlto Copley, Alice Braga (Predators), Diego Luna (Y Tu Mam? Tambi?n), William Fitchtner (Prison Break), Carly Pope (Outlaw), Michael Shanks (Stargate SG-1) and Talisa Soto (Mortal Kombat). The diversity of that roster ? in combination with the Elysium synopsis, indicates that issues of xenophobia and contemporary racism should also be touched on (as they were in D9).

Overall, there appears to be reason enough for fans of cerebral sci-fi to mark their calendars for March 1st, 2013, which is when Elysium begins its theatrical release in the U.S. Naturally, we?ll continue to keep you up-to-date on the project?s status in the meantime.
